Terms of Service
Last updated: 24 May 2025Please read these Terms of Service carefully before using ZygoRIde. By downloading, installing, or using the ZygoRIde application or website (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
1. About ZygoRIde
ZygoRIde ("ZygoRIde", "we", "us", "our") is a peer-to-peer carpooling platform operated by an individual proprietor. ZygoRIde is not a transportation company, taxi operator, or employer of any driver or rider. We provide a digital platform that enables independent individuals ("Ride Providers") to offer empty seats in their private vehicles to other individuals ("Riders") for cost-sharing purposes. The contractual relationship for each ride is between the Ride Provider and the Rider directly — not with ZygoRIde.
ZygoRIde operates as a digital carpooling platform for private cost-sharing arrangements and not as a licensed transport aggregator under Section 93 of the Motor Vehicles (Amendment) Act, 2019. Ride Providers use their own private vehicles for personal travel and share seats purely for cost-sharing purposes. Commercial transportation-for-hire is strictly prohibited on this platform.
2. Acceptance of Terms
These Terms constitute a legally binding agreement between you and ZygoRIde. By registering for or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Services on behalf of a minor for whom you are a legal guardian, you accept these Terms on their behalf.
3. Eligibility
You must be at least 18 years of age to use ZygoRIde as a Ride Provider. Users between the ages of 13 and 17 may use the app as Riders only with verified parental or legal guardian consent, which must be submitted in writing to zygoride.feedback@gmail.com. Users under 13 are not permitted to use ZygoRIde. By registering, you confirm that you meet these requirements. We reserve the right to terminate accounts where age eligibility has been misrepresented.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access at zygoride.feedback@gmail.com. You may not create more than one account per person. Accounts are personal and non-transferable. You must not allow any other person to use your account.
5. Identity Verification
All users must complete identity verification using a valid government-issued photo ID (Aadhaar Card, Passport, Driving Licence, or Voter ID) before posting rides or booking their first ride. Ride Providers must additionally submit their Driving Licence and vehicle Registration Certificate. Providing false, altered, or another person's identity documents is a serious violation and will result in permanent account termination and may be reported to the relevant authorities.
Criminal Background Checks: ZygoRIde conducts government ID and vehicle document verification only. We do not conduct police verification, criminal background checks, or character assessments of any user. You acknowledge this limitation and accept the associated risk when using the platform.
Vehicle Compliance: Ride Providers additionally warrant that their vehicle has a valid Pollution Under Control (PUC) certificate, valid third-party or comprehensive motor insurance as required under the Motor Vehicles Act, and a valid fitness certificate where applicable. Operating a non-compliant vehicle through this platform is a violation of these Terms and Indian law.
6. Ride Posting and Booking Rules
Ride Providers must only post rides they genuinely intend to complete. All ride details — including route, departure time, available seats, and price — must be accurate and up-to-date. Riders must only book rides they genuinely intend to take. Both parties agree to honour confirmed bookings subject to the Cancellation Policy in Section 11. ZygoRIde is not responsible for any Ride Provider's failure to complete a posted ride or a Rider's failure to show up for a booked ride.
7. Prohibited Conduct
You agree not to:
- Use the Services as a commercial taxi operator, auto-rickshaw service, or any transportation-for-hire business.
- Charge fares that significantly exceed reasonable cost-sharing amounts for fuel, tolls, and vehicle running costs.
- Harass, threaten, abuse, or discriminate against other users on any basis including gender, religion, caste, or disability.
- Post false, misleading, or inaccurate ride information.
- Transport illegal goods, controlled substances, or engage in any unlawful activity during a ride.
- Attempt to bypass the in-app messaging system to extract personal phone numbers or other contact details from other users.
- Create fake or duplicate accounts, or impersonate another person.
- Manipulate, fabricate, or coerce ratings and reviews.
- Reverse-engineer, scrape, copy, or otherwise misuse the application, its data, or its source code.
- Violate any applicable Indian law, including the Motor Vehicles Act, Information Technology Act, or any state traffic regulation.
Violations may result in immediate account suspension without prior notice and, where appropriate, legal action.
8. No Insurance — Ride at Your Own Risk
ZygoRIde does not provide any accident, injury, property damage, or liability insurance for any ride arranged through the platform. Ride Providers are responsible for ensuring their private vehicle carries valid third-party motor insurance as required by Indian law. Riders acknowledge that they are travelling in a private vehicle and are not covered by any ZygoRIde insurance policy. You are strongly encouraged to carry personal accident insurance. You use the Services at your own risk.
9. Safety Features Disclaimer
The SOS button and location-sharing features are provided on a best-effort basis. ZygoRIde does not guarantee emergency service response, police response, or any specific outcome when the SOS feature is activated. These features share your location information only; ZygoRIde is not an emergency service provider. Always call 112 (India's national emergency number) in any life-threatening situation. ZygoRIde expressly disclaims all liability for outcomes arising from delays or failures in these safety features.
10. Payments and Pricing
Ride Providers set their own seat prices to offset fuel, toll, and vehicle running costs. ZygoRIde does not currently charge any platform fee, commission, or service charge to Riders or Ride Providers. All payments are settled directly and exclusively between the Ride Provider and the Rider — ZygoRIde does not collect, hold, process, or escrow any payment. Payment disputes are solely between Ride Providers and Riders and ZygoRIde has no liability for such disputes. Do not agree to pay amounts outside what is shown in the app at the time of booking.
Tax Obligations: Ride Providers are solely responsible for compliance with all applicable tax laws, including income tax and GST obligations arising from amounts collected from Riders. ZygoRIde does not deduct tax at source (TDS), does not issue tax receipts or invoices on behalf of Ride Providers, and bears no liability for any Ride Provider's tax non-compliance.
Refund Policy: ZygoRIde does not charge any platform fee, subscription fee, or service charge to Riders or Ride Providers. Therefore, no refund or return policy applies to ZygoRIde itself. Any fare dispute is solely between the Rider and the Ride Provider. ZygoRIde has no obligation to issue any refund of any kind.
11. Cancellation Policy
Either party may cancel a confirmed ride up to 2 hours before the scheduled departure time without penalty. Cancellations made less than 2 hours before departure will negatively affect the cancelling party's reliability score, which is visible to other users. Repeated late cancellations may result in temporary restrictions or permanent account suspension. In an emergency, contact us at zygoride.feedback@gmail.com.
12. Ratings and Reviews
After each completed ride, both Ride Provider and Rider are invited to rate each other on a 1–5 star scale. Ratings are visible within the app and form each user's reputation score. You agree to provide honest, fair, and accurate ratings. Submitting false, retaliatory, or malicious ratings is prohibited and may result in account action. We reserve the right to remove ratings that violate these Terms.
13. Limitation of Liability
To the fullest extent permitted by applicable Indian law:
- ZygoRIde is not liable for any accident, injury, illness, death, loss of property, or any other damage arising from or related to a ride arranged through the platform.
- ZygoRIde does not verify the roadworthiness of any vehicle, the driving ability of any Ride Provider, or the completeness of user-submitted information beyond identity documents.
- ZygoRIde's total aggregate liability to you for any claim arising under these Terms shall not exceed ₹500 (five hundred Indian Rupees) or the fare paid for the specific ride giving rise to the claim, whichever is lower.
- ZygoRIde is not liable for any indirect, incidental, consequential, special, or punitive damages.
14. Dispute Resolution
In the event of a dispute, you agree to first contact us at zygoride.feedback@gmail.com and allow 30 days for an amicable resolution. If the dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India. These Terms are governed by the laws of the Republic of India, including the Information Technology Act, 2000 and rules made thereunder.
15. Intellectual Property
The ZygoRIde name, logo, app design, and all content provided through the Services are the property of ZygoRIde or its licensors. You may not reproduce, distribute, modify, or create derivative works of any ZygoRIde content without our prior written permission.
16. Termination
We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have violated these Terms, posed a safety risk to others, or engaged in fraudulent activity. You may delete your account at any time through the app settings.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. All remaining provisions of these Terms shall continue in full force and effect.
18. Force Majeure
ZygoRIde is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, government actions, civil unrest, internet or power outages, or third-party service failures (including Firebase / Google Cloud outages). We will make reasonable efforts to resume normal operations as soon as practicable.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZygoRIde regarding the Services and supersede all prior agreements, representations, warranties, or understandings, whether written or oral.
20. Changes to These Terms
We may update these Terms from time to time. We will provide notice of material changes via in-app notification or email. Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of those Terms.
